Everything New with ADUs: 2025 ADU Rules and Regulations Now in Effect

A new year for you, and a new day for ADUs. Several laws went into effect on January 1, 2025 regarding ADUs. Here are some highlights that you should know about if you’re looking to build an ADU or have an existing ADU.
Unpermitted ADUs and JADUs
Previously, unpermitted ADU and JADUs that were constructed prior to January 1st, 2020 were deemed ineligible to be permitted. However, AB 2533 stipulates that those structures can receive permits, provided that they adhere to health and safety codes. If they currently fail to comply, homeowners are to be given a checklist of issues to fix before permits can be issued. Furthermore, AD 2533 prohibits local agencies from charging penalties or fees in connection to an ADU or JADU’s unpermitted status.
Multifamily Unit ADUs
Prior to SB 1211, multifamily lots were only allowed to have a maximum of 2 ADUs. However, as of today, multifamily lots can have a maximum of 8 ADUs, as long as the number of ADUs does not exceed the number of units contained in the multifamily primary dwelling. Additionally, these ADUs do not require off-street parking.
ADUs in Coastal Zones
Historically, it’s been harder for homeowners in designated coastal zones – like Los Angeles – to build ADUs. Now, SB 1077 requires that local governments receive guidance on how to amend the coastal zone regulations to streamline and simplify the process of getting approval for their ADUs. Furthermore, interested members of the public will be able to comment on local guidance proposals related to ADUs in their communities.
ADUs and the Law
Recent rules and regulations around ADUs haven’t loosened restrictions. In 2025, homeowners may have an easier time with both approving, permitting, and building their ADUs.
